Reinstating a Delaware Suspended License
A Delaware driver's license can be suspended administratively by the Delaware DMV after a DUI arrest, by the Justice of the Peace court or Court of Common Pleas after a moving-violation conviction, or by the DMV for failure to comply with a court order or financial responsibility requirement. Each suspension type has a different reinstatement path, but every reinstatement runs through one of the four Delaware DMV offices.
Common reasons for a Delaware suspension
- DUI arrest or conviction — administrative revocation under 21 Del. C. §2742.
- Refusal of chemical testing — automatic 1-year revocation under Delaware's implied consent law.
- 12 or more points in a 24-month rolling window — see Delaware point system.
- Driving without insurance — court-ordered suspension under 21 Del. C. §2118.
- Failure to appear or pay — court-imposed suspension that lasts until the underlying ticket is resolved.
- Major moving violations — reckless driving, racing, vehicular manslaughter; revocation lengths set by statute.
The 15-day IID Election window
After a Delaware DUI arrest, the officer issues a Notice of Revocation and the driver receives a temporary driving permit valid for 15 days. The driver has 15 calendar days from the arrest to make the IID Election — agreeing to install an Ignition Interlock Device immediately and continue driving on a hardship license rather than serving the full administrative revocation. The IID Election is the most common path: it preserves driving privileges for work, school, medical care, and IID-monitored personal driving.
Drivers who do not elect IID within 15 days serve the full administrative revocation period (3 months minimum for a first DUI) before they can apply for any driving privileges. The IID Election is filed with the Delaware DMV, not the criminal court, and it does not affect the criminal DUI case.
DUI reinstatement steps
To restore full driving privileges after a Delaware DUI revocation, the driver typically completes:
- Service of the full revocation period or successful completion of the IID Election period.
- A state-approved substance abuse evaluation and any treatment program ordered by the court.
- Completion of a DUI education course approved by the Delaware DMV.
- Mandatory installation of an ignition interlock device (IID) for the period set by Delaware DMV under 21 Del. C. §4177I (mandatory IID for any DUI conviction since 2014).
- An SR-22 certificate of financial responsibility filed by a Delaware-admitted insurer, kept in force for 3 years.
- Payment of all reinstatement fees set by the Delaware DMV.
- An in-person visit to a Delaware DMV office for reissuance.
Hardship and IID-restricted licenses
Delaware's IID Election effectively functions as a hardship license — drivers who elect IID can drive for any purpose during the revocation, as long as the IID is properly installed and reporting clean tests. Drivers who don't elect IID can still apply for an Occupational License after a portion of the revocation has been served, allowing limited driving for work and medical purposes. Both pathways require an SR-22 filing and proof of compliance with any underlying court orders.
SR-22 filings
Delaware requires drivers reinstating after a DUI or certain other violations to file an SR-22 certificate of financial responsibility. The SR-22 is filed by the insurer directly with the Delaware DMV and proves continuous coverage at or above the state minimums. Court-ordered and administrative suspensions
For non-DUI suspensions, the path back depends on the underlying issue. A "failure to appear" suspension lifts when the Justice of the Peace court records the resolution and notifies Delaware DMV (usually 5-10 business days). A no-insurance suspension requires proof of current coverage and a reinstatement fee. A 12-point suspension requires service of the full term plus completion of any defensive driving course Delaware DMV specifies before reissuance.
Reinstatement at the DMV
Once eligible, the driver visits any Delaware DMV office and brings: proof that all underlying conditions have been satisfied (court orders, IID install certificate, SR-22 confirmation), proof of identity and Delaware residency (the standard REAL ID document set), and payment of the reinstatement fee.
