New Mexico Instruction Permit Guide
The New Mexico Instruction Permit is the first stage in the state's graduated driver licensing program. It allows supervised practice driving for new drivers age 15 and up, and it must be held for a minimum of six months before the holder can step up to a Provisional License. New Mexico's permit rules also require completion of a 30-hour driver education course before the permit is issued — one of the more structured first-time-driver pathways in the western United States.
Eligibility
To apply for a New Mexico instruction permit, the applicant must:
- Be at least 15 years old.
- Have completed an approved 30-hour driver education classroom course, plus 7 hours of behind-the-wheel instruction with a certified instructor or 50 hours of supervised driving with a parent or guardian.
- Have a parent or legal guardian sign the consent section of Form MVD-10018.
- Pass the knowledge test and vision screen.
Adults 18 and older may also obtain an instruction permit if they prefer to practice before testing for a full New Mexico driver's license, though there is no minimum holding period for adult drivers.
Documents required
Bring originals of these documents to a state MVD office or a partner office:
- Proof of identity and lawful presence — certified U.S. birth certificate, valid U.S. passport, or Permanent Resident Card.
- Proof of Social Security number — Social Security card, W-2, or pay stub showing the full number.
- Two proofs of New Mexico residency — for minors, the parent's documents may be used along with a school enrollment letter for the applicant.
- Driver education completion certificate.
- Parental consent on Form MVD-10018, signed in front of an MVD agent or notarized in advance.
Fees
The New Mexico instruction permit fee is approximately $10. The fee covers the knowledge test, vision screen, and the printed permit. Partner offices may add a service fee of $10-$20 on top.
Knowledge test
The instruction permit test is the same 25-question multiple-choice exam administered for the standard driver's license. A passing score is 18 of 25. Topics drawn from the New Mexico Driver Manual include speed limits on rural highways and mountain roads, school-zone rules, distracted driving statutes, animal-on-roadway responses, and the steps to take after a minor crash.
Driving restrictions while holding the permit
The New Mexico instruction permit restricts the holder to driving with a licensed adult age 21 or older in the front passenger seat at all times. The supervisor must hold a valid New Mexico license and have at least three years of driving experience. Other restrictions:
- No use of cell phones or wireless communication devices, including hands-free.
- All occupants must wear seat belts.
- No driving between midnight and 5:00 a.m. unless accompanied by a licensed parent or guardian.
- Zero tolerance for alcohol — any detectable BAC results in permit revocation.
50-hour supervised driving log
Before the permit holder can move up to a Provisional License, they must complete and document at least 50 hours of supervised driving, including 10 hours at night. The MVD provides a Certification of Supervised Driving form that the parent or guardian signs and submits when the teen tests for the Provisional License. Driving time logged with any licensed adult age 21+ with three years of experience counts — not only a parent.
6-month holding period
The instruction permit must be held for a minimum of six months before the holder is eligible to test for a Provisional License at age 15 years 6 months. A traffic conviction during the six-month period restarts the clock from the conviction date.
Permit duration and renewal
An instruction permit is valid for up to one year. If the holder turns 16 without completing the supervised driving requirement, the permit can be renewed for an additional period at half the original fee. Permits expire automatically once the holder upgrades to a Provisional License or full driver's license.
Out-of-state teen drivers transferring in
A teen with an out-of-state learner's permit must apply for the equivalent New Mexico instruction permit within 30 days of establishing residence.
