USVI Provisional License (Teen Driver)

The USVI provisional license is the middle stage of the territory's graduated driver licensing path — between the learner permit at 16 and the unrestricted license at 18. The provisional license lets a 17-year-old drive without a supervising adult, but with passenger and curfew restrictions designed to limit the riskiest combinations for new drivers on left-side roads.

Eligibility

To qualify for a USVI provisional license, the applicant must:

  • Be at least 17 years old.
  • Have held a USVI learner permit for sufficient practice time (typically 6 months or more).
  • Have completed adequate supervised driving practice on USVI roads.
  • Have a parent or guardian sign the continuing financial responsibility affidavit.
  • Pass the USVI BMV road test on left-side roads.
  • Be enrolled in school or have completed high school.

Documents and fee

Bring originals of the documents already used for the permit (birth certificate or passport, Social Security proof, two residency proofs), the surrendered learner permit, and a completed BMV-1 application updated for the provisional stage. The provisional license fee is approximately $20; verify with the BMV office on your island as fees adjust periodically.

Passenger restrictions

USVI provisional license holders are subject to passenger limits during the first 6 months. The holder may carry no more than one non-family passenger under age 21, regardless of whether a sibling or parent is also in the vehicle. The restriction does not apply when a parent, legal guardian, or other licensed driver age 21 or older is in the front passenger seat.

After 6 months without a moving-violation conviction, the passenger restriction relaxes — the driver may carry passengers without strict numerical limits, subject to seatbelt and gross weight rules. The full passenger restriction lifts when the driver advances to a full license at 18.

Curfew

USVI provisional license holders may not drive between 11 p.m. and 5 a.m. unless one of the following applies:

  • A parent, legal guardian, or licensed adult 21 or older is in the front passenger seat.
  • The trip is to or from work, with employer documentation in the vehicle.
  • The trip is to or from a school-sponsored activity, with school documentation.
  • The trip is for an emergency, including transporting a sick or injured person.

The curfew applies until the driver advances to a full license. The rule is enforced more visibly on tourist-volume routes (the bay roads of St. Thomas, Centerline Road on St. Croix) where police presence is higher in evening hours.

Cellphone and seatbelt rules

USVI bans handheld cellphone use by provisional license holders. Hands-free use is permitted but discouraged in the manual. All passengers must wear seatbelts at all times — USVI's primary seatbelt enforcement rule applies. Texting while driving is illegal for any driver in USVI, but provisional drivers are subject to the additional handheld-cellphone prohibition.

Advancing to a full license

The provisional license converts to a full unrestricted USVI driver's license when:

  • The driver turns 18, regardless of provisional history.
